Policy on Trademark & Copyright

Trademark Copyright Policy
DSQuorum LLC, which does business as Data Society, and its affiliates (“Data Society”) have a reputation for providing high-quality products and services. Data Society’s trademarks are important corporate assets and Data Society requires that they be used properly. To preserve its reputation and protect its trademarks, Data Society diligently guards against any violation of its trademarks. Data Society acknowledges the desire of third parties to show affiliation with Data Society. Without written permission from Data Society, however, you should not use Data Society’s trademarks, service marks, or names in a manner that suggests affiliation or association with Data Society. Only parties with written permission from Data Society are allowed to use Data Society’s trademarks in accordance with applicable terms.

DATA SOCIETY TRADEMARKS

Data Society maintains a portfolio of trademarks, which take various forms and may include letters, words, logos, designs, images, slogans, colors, product shapes, product packaging, and sound. Among those trademarks is a standard character service mark for “DATA SOCIETY” (irrespective of capitalization). Certain activities may constitute infringement or dilution of Data Society’s trademarks, and are not permitted. Please review the following list of ways to avoid unauthorized use of Data Society’s trademarks:

Do not use a Data Society trademark or name in a manner that is likely to cause confusion about the origin of any product, service, material, course, technology, program or other offerings.
Unless you have prior permission from Data Society, do not use a Data Society trademark or name in a manner that is likely to give the impression or otherwise imply an affiliation or association between you, your products or services, and Data Society, or any of its products, services, programs, materials, or other offerings.
Do not use the Data Society corporate logo or any other Data Society logo in any materials without the written permission of Data Society.
Do not use any Data Society trademark or name as or as part of a company, product, service, solution, technology, or program name.
Do not use a Data Society trademark or name in a manner that is likely to dilute, defame, disparage, or harm the reputation of Data Society.
Do not use any trademark, name, or designation that is confusingly similar to the Data Society name or any Data Society trademark.
Do not copy or imitate any Data Society trade dress, type style, logo, product packaging, or the look, design, or overall commercial impression of any Data Society website, blog, or other materials.
Do not register or use any domain name that incorporates any Data Society mark or name.
Do not register or seek to register a Data Society trademark or name, or any mark or name that is confusingly similar to a Data Society mark or name.


DATA SOCIETY CORPORATE LOGO

Unless you have prior written permission from Data Society, do not use the Data Society corporate logo to show or imply an affiliation with Data Society. Qualified third parties can show an affiliation or association with Data Society through Data Society’s authorized programs.

PERMISSIBLE USE

As stated above, you should not use Data Society’s marks or names in any way that implies an association or affiliation with Data Society unless you have prior permission from Data Society. Data Society does grant permission to third parties to use its marks and names where appropriate. In addition to complying with the other aspects of this Policy, and provided you have prior written permission from Data Society, any such permissible use of Data Society’s marks or names also must comply with the following Guidelines and any license or usage requirements for use of the specific mark or logo.
Data Society acknowledges that the use of Data Society trademarks, excluding any Data Society logos, may be necessary to refer to Data Society’s products or services or to describe the subject matter of some materials, products, and/or programs. All such use must be accurate and descriptive in nature and comply with this Policy and these Guidelines.

Do not alter, adapt, modify, animate, or morph any Data Society trademarks. Examples of what not to do include abbreviating or shortening a trademark (for example, Data Society to DS), combining or hyphenating a trademark with another prefix or word (for example, Data Society-led), or using a slash mark with any trademark (for example, Data Society/XYZCo).
Do not use the Data Society name or Data Society trademarks next to your name or the name of your products or services.
Do not use the Data Society name or any Data Society trademark as part of a product, service, solution, or program name.
Do not combine any Data Society name or mark with any other letters, numbers, words, or any design or logo.
Do not use any Data Society name or trademark as the visual focal point of any materials.
The Data Society name or Data Society trademarks must not be more prominently displayed than your name or your product or service name.
The Data Society name or Data Society trademarks must be visually distinguishable from your name and your product and service names.
All reference to Data Society or use of any Data Society mark or name must be truthful, accurate, and not misleading.
Do not use Data Society’s trademarks as nouns. Data Society’s trademarks must be used as adjectives with nouns that properly and accurately identify the Data Society product, service, program, material, or technology to which you are referencing.
Always use the proper spelling for Data Society’s trademarks.
Do not use a Data Society trademark in the plural or possessive form.
Plural example:

Do not say: Data Societies

Do say: The Data Society communities.

Possessive example:

Do not say: Data Society’s unique look.

Do say: The unique look of a Data Society learning management system.

Do not use Data Society’s marks or names in any way they were not intended to be used. Data Society’s marks should be used for the corresponding product or services for which they were originally intended.
Use the ® or ™ symbol in connection with any Data Society trademark and the following acknowledgement of Data Society’s ownership of its marks and/or logos: “[insert permissible mark] [is a/are] registered trademark[s] or trademark[s] of Data Society Systems, Inc. and/or its affiliates in the United States and certain other countries.”..

Copyrights


All Data Society course content, platform content, instructional videos, printed and online course materials, exercises, cheat sheets, code banks, white papers, product documentation, and other copyrighted materials (collectively “Copyrighted Materials”) will be used only as explicitly licensed or permitted by Data Society, and only under the terms and conditions and for the purposes described in such license or permission. The party to which licenses are granted is referred to as the “Licensee” in all written and online license agreements. To the extent any specific license to Copyrighted Materials between Data Society and Licensee conflicts with the general terms below, the specific terms of such license govern all use of the Copyrighted Materials by the Licensee. Data Society reserves the right to update these guidelines at any time.
Approval Process.All specific uses of any Copyrighted Materials must be approved in advance by Data Society. Submit requests via hello@datasociety.co, Data Society will reply at its earliest convenience, though it is under no obligation to respond. Approved requests may require execution of a separate license agreement with additional terms and conditions. You may not use Copyrighted Materials unless and until Data Society has granted its specific approval (by execution of a license agreement or delivery of other permission) and any and all conditions of such approval have been fulfilled by the Licensee.
Copyright Notices.All Copyrighted Materials provided hereunder will carry the following notice:
“These materials have been reproduced by with the permission of Data Society COPYRIGHT © DATA SOCIETY, ALL RIGHTS RESERVED.”

Restrictions upon Use.The Copyrighted Materials will not be presented or used: a) in a manner that suggests that editorial content has been authored by, or represents the views or opinions of, Data Society or any Data Society personnel or affiliate; b) in a manner that is misleading, defamatory, libelous, obscene, infringing or otherwise objectionable; c) in connection with any material that infringes the trademark, copyright or any other rights of any third party; or d) in a manner that infringes, derogates, dilutes, or impairs the rights of Data Society in the Copyrighted Materials. Data Society shall have complete discretion to evaluate Licensee’s use and to decide whether that use violates any of the foregoing restrictions.
Revocation Right. Data Society retains the right to revoke any licenses or permissions to use Copyrighted Materials at any time, in its sole discretion. Any such revocation by Data Society is expressly subject to the Consequential Damages Waiver below.

No Warranty. ALL MATERIALS ARE PROVIDED BY DATA SOCIETY “AS IS” WITH ALL FAULTS. DATA SOCIETY DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED INCLUDING, WITHOUT LIMITATION, THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OR ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

Consequential Damages Waiver. IN NO EVENT WILL DATA SOCIETY BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES INCLUDING WITHOUT LIMITATION, LOST PROFITS, OR LOSS OR DAMAGE TO DATA ARISING OUT OF THE USE OR INABILITY TO USE ANY COPYRIGHTED MATTER, EVEN IF DATA SOCIETY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
